Terms of Service.

Agreement to Terms

By accessing or using the CreatorsBay platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all Terms, you may not access the Platform. These Terms apply to all users including Brands (Advertisers) and Creators (Influencers).

The Platform

CreatorsBay is an influencer marketing platform that facilitates connections between brand advertisers and content creators for paid collaboration campaigns. We provide the technology infrastructure, campaign management tools, payment processing, and dispute resolution services. We are not a party to the creative agreements between Brands and Creators.

Account Registration

• You must be at least 18 years of age to register an account.
• You must provide accurate, complete, and current registration information.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorised use of your account.
• One person or entity may not maintain more than one account.
• Accounts are non-transferable.

Creator Terms

Profile and Content

• Your creator profile must accurately represent your identity, follower counts, and content categories.
• Misrepresenting your audience metrics, engagement rates, or follower authenticity is grounds for immediate account termination.
• You retain ownership of the creative content you produce for campaigns, subject to any usage rights granted to the brand as per the campaign brief.

Campaign Participation

• By accepting a campaign, you commit to delivering the agreed content within the specified deadline.
• Deliverables must match the campaign brief's requirements regarding platform, format, and content guidelines.
• Failure to deliver without valid reason may result in cancellation fees, negative ratings, or account suspension.
• You must disclose paid partnerships in your content as required by applicable advertising standards (ASCI guidelines in India).

Payments

• Campaign earnings are credited to your CreatorsBay wallet upon brand approval of deliverables.
• Withdrawals are processed to your registered bank account within 3–5 business days.
• CreatorsBay may charge a platform service fee on transactions, as disclosed at the time of withdrawal.

Brand Terms

Campaigns

• Campaign briefs must be honest, legal, and compliant with applicable advertising regulations.
• You may not request content that is misleading, discriminatory, defamatory, or promotes illegal activities.
• Campaign budgets must be funded before the campaign is approved and made live.
• Campaign approval fees (if applicable) are non-refundable once the campaign is made live.

Creator Relations

• You must review and approve or reject creator deliverables within 7 days of submission. Failure to act within this period constitutes automatic approval.
• Rejection of deliverables must be accompanied by specific, objective reasons aligned with the original brief.
• You may not use creator content beyond the scope agreed in the campaign brief without additional written agreement.

Prohibited Conduct

Users must not:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Post false, misleading, or deceptive information.
• Attempt to circumvent the Platform by arranging off-platform payments to avoid service fees.
• Harass, abuse, threaten, or intimidate other users.
• Upload malware, viruses, or any other malicious code.
• Scrape, crawl, or harvest data from the Platform without written permission.
• Impersonate any person or entity.

Intellectual Property

The CreatorsBay name, logo, platform design, and all proprietary technology are owned by Concept Crafters and protected by applicable intellectual property laws. Users may not reproduce, distribute, or create derivative works without our express written permission.

Dispute Resolution

If a Brand and Creator cannot resolve a dispute regarding deliverables, either party may raise a formal dispute through the Platform. CreatorsBay will review the dispute and issue a binding decision within 14 business days. Our decision considers the original campaign brief, submitted deliverables, and communications on the Platform.

Limitation of Liability

To the maximum extent permitted by law, CreatorsBay and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 3 months preceding the claim.

Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, any pending wallet balance will be reviewed and refunded less any applicable fees, subject to our investigation period.

Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.

Changes to Terms

We may modify these Terms at any time. We will provide at least 15 days' notice of material changes via email or platform notification. Continued use after the effective date constitutes acceptance of the revised Terms.
